13. Dispute Resolution

13.1 Informal Resolution

We will attempt in good faith to resolve the dispute within thirty (30) days of receiving your written notice. If the dispute is not resolved within that period, either party may proceed with the dispute resolution mechanism described below.

13.2 Binding Arbitration

EXCEPT FOR DISPUTES THAT QUALIFY FOR SMALL CLAIMS COURT OR AS DESCRIBED IN SECTION 13.4 BELOW, ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES SHALL BE RESOLVED EXCLUSIVELY THROUGH FINAL AND BINDING ARBITRATION.

The arbitration shall be conducted by a mutually agreed-upon neutral arbitrator, or if no agreement is reached, by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules, which are available at www.adr.org. The arbitration shall be conducted in English and, unless otherwise required by law or agreed upon by both parties, shall take place in the county or state in which Anthony's Coal Fired Pizza's principal place of business is located.

The arbitrator shall have the authority to award any remedy that would be available in a court of competent jurisdiction. The arbitrator's award shall be final and binding, and judgment may be entered on the arbitration award in any court having jurisdiction.

13.3 Class Action Waiver

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND ANTHONY'S COAL FIRED PIZZA AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. Unless both parties agree in writing, no arbitrator or court may consolidate more than one person's claims or otherwise preside over any form of representative or class proceeding.

13.4 Exceptions to Arbitration

Notwithstanding the above, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information. You may also bring a claim in small claims court if the dispute qualifies under applicable rules of that court.

14. Term and Termination

These Terms shall remain in full force and effect while you use our Website or Services. We reserve the right, in our sole discretion, to:

  • Suspend or terminate your access to the Website or Services at any time and for any reason, including for violations of these Terms;
  • Refuse service to any person or entity;
  • Cancel or refuse any order;
